This website is owned and operated by zavvi Online (Guernsey) Limited ("ZOG/we/us"), a company registered in Guernsey under company number 46352 and whose registered address is 3rd floor Wolverton Place, Market Square, St Peter Port, Guernsey GY1 1HB. All users of this website are bound by these terms and conditions so please read these carefully before going on. Your use of this site and the information available on this site is subject to the terms and conditions set out below and by using this site you are acknowledging your consent to them. ZOG, in its sole discretion, reserves the right to change these terms and conditions at any time without notice, although any changes will be posted here. By browsing the website you accept that you are bound by the current terms and conditions and notices and we therefore recommend that you check these each time you revisit the site.

Contract Formation

When you place an order to purchase a product on our website, your order is an offer to purchase those products. We will then send you a confirmatory e-mail setting out the details of your order. A contract will only come into existence in respect of each of the products ordered when we send you an e-mail confirming that we have dispatched those products to you.

Price

All prices shown on our website are inclusive of all applicable local taxes and duties for delivery to the UK.

We reserve the right to alter product prices on the website to reflect any increase in the cost of the products for reasons beyond our reasonable control, this may include (but is not limited to) pricing mistakes, tax or other duty increases.

Whilst we make every effort to ensure that all prices on our website are accurate and up to date sometimes errors do occur and the prices stated are incorrect. Where the correct price is lower than the one on our website we will only charge you the lower amount. If the correct price is in fact higher than the price on our website we will either: contact you and discuss the pricing error before we proceed with your order, or notify you of the error and cancel your order.

Prices online may differ from those in the zavvi stores.

Availability

When you order an item the website will give you an indication of its availability. These indications and any dispatch times are estimates only and should not be relied upon as guaranteed. Due to the fast moving nature of the our stock, all orders are subject to availability until they have been confirmed by us. We will not charge your card until the item is in stock and has been allocated to your order.

Items marked as “Usually dispatched within 1-2 days” “Usually dispatched within 7 days” “Usually dispatched within 2 weeks”, “Usually dispatched within 2-4 weeks” and "Usually dispatched within 4-6 weeks."

If the product is listed as "Usually dispatched within 1-2 days”, “Usually dispatched within 7 days”, “Usually dispatched within 2 weeks”, “Usually dispatched within 2-4 weeks” or "Usually dispatched within 4-6 weeks", this means that we have no copies available in our warehouse and we will have to order the item from our suppliers. This can take as little as 1-2 days but as it depends on the stock situation at the supplier, this is out of our control. We will continue trying to source the product from the supplier after you order. If we cannot source it within 60 days we will cancel your order and send you a cancellation email. In the event that we cannot accept an order due to the product being out of stock then we shall be under no obligation to supply the goods or services ordered at the price the order was originally made at.

Dispatch estimates are for working days.

Once these items are in stock at our warehouse we will dispatch them within 24 hours.

Availability of new and pre-ordered items:

New release dates are given subject to information received from our suppliers. We shall not be responsible if the new release is delayed, cancelled or the content or cover art is changed. Where a new release is cancelled we will cancel your order and immediately refund your card with any monies taken.

Availability of limited editions:

Please note that we sell a number of limited edition products via our website, which by their very nature are limited in number. As such, availability is on a strictly first come first served basis. Whilst we will endeavour to fulfil your order, once our supplies are exhausted all outstanding orders will be cancelled and your card will be immediately refunded with any monies taken. We will not be responsible for compensating you for any other losses connected with the purchase of limited edition products.

Availability of products in limited supply:

Where products being sold by zavvi are in limited supply, we may restrict individual customer purchases to 1 unit. This is to ensure fair distribution to all our customers. Orders placed for more than 1 unit will be automatically cancelled.

Affected products will have a clear message informing you if they are subject to this restriction on their detail pages, and further information regarding products in short supply can be found on our Customer Services page.

Competitions

When you enter a competition or other promotional feature, we will ask for your name, address and e-mail address so we can administer the competition and notify winners. Unless you tell us otherwise, we will not use the information collected during competitions for any other purposes.

Please note that there may be specific terms and conditions attached to individual competitions, which will be highlighted for each competition. General competition terms and conditions are as follows:

Customer Reviews

You may submit reviews of products on this website but must make sure that the content of any submission you make is not illegal, defamatory, obscene, offensive and does not infringe any third party's intellectual property rights. Due to the large numbers of products, reviews and comments listed on our website it is not possible for us to always be aware of the content of each one, but we do reserve the right to remove and edit content if we become aware of anything which is defamatory or otherwise in breach of the submission policy set out in these terms.

In posting reviews or submitting other material you grant us a non-exclusive, royalty free, perpetual and irrevocable worldwide right (with the ability to sublicence) to use and reproduce such content on any media. Although we may use any name under which you submit your review, you waive any right to insist to be identified as the author and also waive any right to object to our treatment of your submission. If you submit anything which contravenes our submission policy, we may ask you to indemnify us against any losses we may suffer as a consequence. If you do become aware of any postings on our site which you believe to be defamatory or in breach of this submission policy, please let us know by contacting our Customer Services team and we will endeavour to remove any offending content as quickly as possible.

Please note that any reviews that contain links to other websites in competition with zavvi.co.uk will not be published, nor will those that are submitted by the suppliers of the products involved.

Limitation of Liability

We do not exclude or restrict liability for death or personal injury resulting from our negligence.

We will only be liable for losses which are foreseeable to both you and to us as a consequence of us breaching these terms and caused by our own negligence. We will not be responsible for any commercial or business losses (including without limit loss of goodwill, profits, contracts, anticipated savings, data, or wasted expenditure) or any other indirect or consequential loss that was not reasonably foreseeable to both you and us at the time our contract was formed, or at the time you began using the website.

Nothing in these terms shall affect your statutory rights. If you have any doubts as to your statutory rights then you should contact your Local Citizens Advice Bureau or refer to the Office of Fair Trading website (www.oft.gov.uk/default.htm).

These links are provided merely as a service to users of the site and inclusion in this site does not constitute an endorsement by or affiliation with ZOG. Any goods that you order from any website to which you link from this site are subject to any terms and conditions applicable to such website and we shall have no liability to you in respect of such sites or any goods or services you may obtain from them. These websites may collect data or solicit personal information from you. Those sites are not subject to our Privacy Policy. You should make sure you are happy with the terms and conditions and privacy policies on any such site before you use it.

Waste Electrical and Electronic Equipment

In the UK, retailers of electrical items and electronic equipment are obliged to accept back these products when customers buy a new, similar product. Retailers are exempt from taking electrical equipment back from customers if they join a national ‘Take Back Scheme’ and direct customers to take old equipment to their local recycling centres.

zavvi is a member of the UK’s national take back scheme and as such is exempt from receiving waste electrical items from customers.

Recycling

Jurisdiction

These terms shall be construed and interpreted in accordance with the relevant United Kingdom law. The courts of the United Kingdom will have exclusive jurisdiction in relation to any claim, dispute or other matters arising from these terms, your use of the website or the supply of products by us.
